    Terms of Service

    1. Acceptance of these Terms

    These Terms of Service ("Terms") govern your access to and use of TransportationCareers at transportationcareers.ca (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

    2. Eligibility

    You must be at least 16 years old and capable of forming a legally binding contract under applicable Canadian law to use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, in which case "you" refers to that entity.

    3. Accounts

    To access most features, you must create an account. You agree to provide accurate, current, and complete information, to keep that information up to date, and to keep your password confidential. You are responsible for all activity that occurs under your account. You agree to notify us immediately by opening a support ticket if you notice any unauthorized use of your account or other security breach.

    4. Acceptable use

    You agree not to:

    • post fraudulent, misleading, discriminatory, or otherwise unlawful job listings, profiles, or applications;
    • impersonate any person, company, or organization, or misrepresent your affiliation;
    • harass, abuse, threaten, or discriminate against other users;
    • scrape, crawl, or systematically extract data from the Service in violation of our robots.txt or rate limits;
    • upload viruses, malware, or any code designed to disrupt the Service;
    • attempt to gain unauthorized access to any part of the Service, related systems, or networks;
    • use the Service to send spam, unsolicited commercial messages, or chain letters;
    • use the Service for any unlawful purpose or in violation of any applicable law or regulation.

    We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate these Terms, with or without notice.

    5. Job listings (employers)

    Employers are solely responsible for the accuracy, legality, and content of the job listings they post and for compliance with all applicable employment, human-rights, and accessibility laws. You agree that listings will:

    • describe a real employment opportunity;
    • not discriminate on the basis of any protected ground under applicable Canadian human-rights law;
    • not contain misleading compensation, location, or work-authorization claims;
    • not request fees from candidates as a condition of applying or being considered.

    We may remove listings that violate these requirements, with or without notice.

    6. Applications (job seekers)

    Job seekers are solely responsible for the content of their applications and profiles, including the accuracy of any educational credentials, employment history, and authorization to work. By submitting an application you authorize TransportationCareers to share your application materials with the employer of the role you applied to.

    7. Fees and payments

    Some features of the Service require payment (for example, credits to post jobs or optional employer subscriptions). All fees are clearly displayed in Canadian dollars before purchase and processed by our third-party payment processor. By making a purchase, you authorize us (and our payment processor) to charge your payment method.

    Unless expressly stated otherwise at the time of purchase or required by law, fees are non-refundable. Subscription plans renew automatically until cancelled; you can cancel from your dashboard at any time and your plan will remain active until the end of the billing period.

    8. Content ownership and licence

    You retain ownership of the content you submit to the Service (job listings, profiles, resumes, messages, etc.). By submitting content, you grant TransportationCareers a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce, and distribute that content as needed to operate, promote, and improve the Service. This licence ends when you delete the content or your account, except for copies retained as required by law or in routine backups.

    The Service itself — including its software, design, layout, trademarks, and aggregated data — is owned by TransportationCareers and its licensors and is protected by Canadian and international intellectual-property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

    9. Third-party links and services

    The Service may contain links to third-party websites and services that we do not control. We are not responsible for the content or practices of those websites and services. Your use of any third-party site or service is subject to that party's own terms and privacy policy.

    10. Disclaimers

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any job seeker will be hired or that any employer will receive qualified applications. We make no warranty regarding the accuracy, completeness, or reliability of any user-submitted content, including job listings and profiles. You use the Service at your own risk.

    11. Limitation of liability

    To the maximum extent permitted by applicable law, in no event shall TransportationCareers, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CA$100).

    12. Indemnification

    You agree to indemnify and hold TransportationCareers, its officers, directors, employees, and agents harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any applicable law, or (d) your infringement of any third-party right.

    13. Termination

    You may close your account at any time from your dashboard or by opening a support ticket. We may suspend or terminate your account, or your access to all or part of the Service, at any time and without notice if we believe you have violated these Terms, if required by law, or for any other reason. Sections 7 (Fees), 8 (Content ownership), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnification), and 14 (Governing law) survive termination.

    14. Governing law and dispute resolution

    These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any dispute arising out of or related to these Terms or the Service, except where local consumer-protection law gives you the right to bring proceedings in a different jurisdiction.

    15. Changes to these Terms

    We may revise these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where significant, communicated by email to account holders. Continued use of the Service after a change indicates acceptance of the revised Terms. If you do not agree with a change, your remedy is to stop using the Service and close your account.

    16. Severability and entire agreement

    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TransportationCareers regarding the Service and supersede all prior agreements and understandings on the subject.
